This Pro Agreement applies in addition to our Terms of Service to anyone who creates a Pro profile or offers services through Master of All Trades, a platform operated by 102243324 Saskatchewan Inc.. If the two conflict, this Agreement governs for Pro matters.
1. You are an independent business
You provide services as an independent business, not as our employee, agent, partner or franchisee. You decide which requests to quote on, your prices, methods, schedule and whether to accept a job. Nothing in this Agreement creates an employment relationship. You are responsible for anyone who works for you or with you.
Business accounts only. You use Master of All Trades as a business - a sole proprietorship, partnership or corporation - and you confirm this when you set up your Pro profile. Lead credits, the subscription and the verification fee buy advertising and software services for your business. They are not a fee for finding employment, and Master of All Trades is not an employment agency or recruiter. If a request turns out to be a job offer or recruitment rather than a project, report it and we will remove it and refund your lead credit.
2. Licences, insurance and the law
You must:
- hold every licence, permit, registration, certification and insurance required for the services you offer, where you offer them, and keep them current;
- comply with all applicable laws, including building codes, safety, consumer protection, employment standards, human rights and privacy laws;
- for child care, comply with your province's child care legislation, including limits on the number and ages of children cared for without a licence;
- for services involving children, vulnerable people or entering people's homes, be prepared to provide a current criminal record or vulnerable sector check on request;
- not offer any service listed as prohibited in our Community Guidelines.
We strongly recommend that you carry commercial general liability insurance appropriate to your trade.
3. Your profile and quotes
- Everything in your profile must be accurate and not misleading - including your business name, experience, photos, licences and service area. Only use photos of your own work.
- Only claim to be licensed, insured, bonded or background-checked if it is true, and be ready to prove it.
- A quote is your offer to the customer. Make its price, what's included, timing, deposit and any extra costs clear. Honour the prices you quote unless the job turns out materially different from what the customer described.
- Put the final agreement with the customer in writing where the law or good practice requires it.
4. Lead credits, subscription and verification fee
- Sending a quote on a job request costs one lead credit, charged when you send it. The number of Pros who can quote on each request may be limited.
- A lead is an opportunity, not a guaranteed job. We don't guarantee that a customer will reply or hire.
- The optional Pro subscription and one-time verification fee are described on the Platform before you buy.
- Refunds are covered by our Refund & Cancellation Policy.
- Prices exclude applicable taxes unless stated. We may change prices for future purchases at any time; for subscriptions we give at least 30 days' notice.
5. Taxes
You are responsible for your own income taxes and for registering for, charging and remitting GST/HST/PST on your services where required. Customers pay you directly for your work.
6. Customer information
When a customer shares information with you through the Platform (for example their address, phone number or photos of their home), you may use it only to quote on, arrange and perform that job and to follow up about it. You must:
- keep it secure and confidential;
- not sell it, share it, or add the customer to marketing lists without their separate consent - Canada's Anti-Spam Legislation (CASL) applies to you;
- delete it when you no longer need it for the job or your legal records.
You are responsible for complying with privacy law for the information you hold.
7. Reviews and conduct
Follow our Review Policy: never write reviews of your own business, pay or pressure customers for reviews, or offer incentives for positive reviews. Treat customers respectfully and follow our Community Guidelines.
8. Verification and badges
The Verified Pro badge is governed by our Pro Verification Standards. You must keep the documents behind it current and tell us promptly if a licence or insurance lapses. We may remove the badge if the documents expire, turn out to be inaccurate, or you breach this Agreement.
9. Featured placement
If you pay for featured placement, your listing is labelled "Featured". It doesn't change your reviews or rating, and it doesn't guarantee any number of leads.
10. Your content
You keep ownership of your profile content and photos. You grant us the licence described in our Terms, including to show your business name, logo and photos in search results and to promote the Platform. You confirm you have the rights to everything you upload.
11. Responsibility for your work
You are solely responsible for your services and for any damage, injury or loss they cause. To the extent permitted by law, you agree to indemnify 102243324 Saskatchewan Inc. against third-party claims arising from your services, your breach of this Agreement or the law, or your content.
12. Suspension and ending
You may stop using the Platform and close your Pro profile at any time. We may suspend or remove your profile, badge or access, or refuse quotes, if we reasonably believe you breached this Agreement or the law, received serious or repeated complaints, or created a risk to users. Where appropriate and lawful we'll tell you why and give you a chance to respond.
13. Changes
We may update this Agreement as described in our Terms. For material changes we give notice and ask you to accept the new version.
